Services to Minors with Contested Consent or Custody:

  • Wellness Solutions believes that both parents play important roles in the lives of their children, regardless of the parents’ marital status or custody situation, as a result, it is necessary to include both parent(s)/guardian(s) and/or client’s representative(s) in the treatment process.

  • Wellness Solutions requires both legal parent(s)/guardian(s) of minors to sign all clinical documentation. This is a requirement to begin receiving treatment and there are no exceptions to this policy. 

  • Wellness Solutions requires the parent(s)/guardian(s) of minors subject to a custody agreement to submit the final divorce decree with case number located on each page prior to scheduling an appointment. The decree must include the signature page with the judge’s signature and dated. This policy is compliant with Texas state law and is a requirement for minors to receive regular, non-emergent, mental health treatment.

  • If the mental health/psychological rights have been modified in a modification order, the parent(s)/guardian(s) is/are required to submit both copies (divorce decree and modification order) to Wellness Solutions prior to scheduling an appointment. Further, both of the aforementioned orders must be filed with the court and have a case number for verification purposes- attorney’s initial court filing copies will not be accepted.

  • This is to verify which parent has legal custodial guardianship with the legal right to consent for non-emergent outpatient mental health treatment. This is both a legal and ethical requirement for providers in the state of Texas. Individuals who provide false or misleading information may be in violation of the law, as well as, court order.

  • For minor clients who are adopted, it is required to provide Wellness Solutions a copy of court recorded adoption papers and/or a birth certificate. This information verifies that the child is legally in your custody and that the individual providing consent for non-emergent outpatient mental health treatment has the legal right and authority to do so. The relevant aforementioned requirements also apply.

  • For minor clients who were not subject to a custody agreement at the time of admission and become subject to a custody agreement or guardianship while under the care of Wellness Solutions the aforementioned requirements and standards apply.

  • For adult clients who are the subject of guardianship  it is required to provide Wellness Solutions a copy of court recorded adoption papers. The relevant aforementioned requirements also apply.

  • We understand that the above can be a burden and it is certainly not our intention to cause undue stress. The aforementioned policies are legal and ethical requirements to ensure providers engage in due diligence to determine who has mental health rights of a minor or adult with guardianship prior to treatment. It is in everyone’s best interest that we follow all relevant ethics and laws pertaining to child custody and adult guardianship. If you do not feel comfortable with this policy we respect your right to choose another provider.

  • If there are significant conflicts between the minor client and a parent then Wellness Solutions maintains that the issues in the conflicted relationship are areas of clinical concern and require clinical intervention. Wellness Solutions does not condone or participate in parental alienation. Therefore, Wellness Solutions will not provide treatment to an individual without the knowledge and/or participation of a parent. In the event that a parent/guardian refuses to sign the Wellness Solutions intake documents then the prospective minor client will not be permitted to schedule an appointment.

  • Wellness Solutions will not provide treatment to any individual where there is conflicted parent or guardian consent.

  • In order to verify the authenticity of the individual signing all intake documents Wellness Solutions requires three forms of identification including one official picture ID to be included with the completed documents.

  • At least one parent/guardian/client representative is required to accompany minors to the first appointment and, dependent upon the age of the client, to all subsequent sessions.

  • We understand that this is may be an inconvenience, and that other family members, such as, siblings, step-parents, grandparents, or caregivers, such as, nannies or babysitters, play an integral part in the child rearing process. However, at least one parent/guardian/client representative is required to accompany minors to the first appointment.

  • A step-parent/sibling/friend/neighbor of the minor client or girlfriend/boyfriend/friend/partner/spouse with non-custodial rights such as a second wife/husband/significant other of the parent/guardian/client representative may NOT accompany a minor client to the first appointment in the place of a parent/guardian/client representative or, dependent upon the age of the client, to all subsequent sessions.

  • A girlfriend/boyfriend/friend/partner/spouse with non-custodial rights such as a second wife/husband/significant other of the parent/guardian/client representative does NOT have a right to participate in the treatment of a client under most circumstances and Wellness Solutions, LLC reserves the right to decline the participation of said individuals.

  • Wellness Solutions reserves the right to decline the participation of any support system persons based on clinical judgment and individual circumstances.

  • Please be aware that Wellness Solutions staff do not provide information regarding a minor client’s treatment to anyone other than the client’s parent(s)/guardian(s)/client representative(s) or individuals for whom there is an active signed consent to release information on file.

  • Wellness Solutions requires a parent(s)/guardian(s)/client representative(s) to attend the intake or first session, as well as, all subsequent sessions of his/her/their minor child.

  • Wellness Solutions requires a parent(s)/guardian(s)/client representative(s) to take responsibility for the behavior of and provide supervision of his/her/their minor child who is 15 years of age or under while said minor child is on Wellness Solutions premises. Hence, a parent(s)/guardian(s)/client representative(s) is responsible for providing and maintaining proper supervision of the minor. A parent(s)/guardian(s)/client representative(s) may or may not participate or be present in all or some regular or routine sessions depending on individual circumstances and situations.

  • Wellness Solutions allows client’s who are of driving age to drive himself/herself to Wellness Solutions for his/her appointments and present to sessions without his/her parent(s)/guardian(s)/client representative(s) presence or supervision. (This pertains to regular sessions and not intake sessions/first sessions.)

  • Wellness Solutions reserves the right to require the parent(s)/guardian(s)/client representative(s) of said minor clients who are of driving age to attend the session of, take responsibility for the behavior of, and provide supervision of his/her/their minor child based on individual circumstances and situations while on Wellness Solutions premises. A parent(s)/guardian(s)/client representative(s) may or may not participate or be present in all or some sessions depending on individual circumstances and situations.

  • Wellness Solutions requests that parent(s)/guardian(s)/client representative(s) of minor clients assist our staff in maintaining a respectful, private, and calming treatment environment by refraining from inviting guests, family members, minors, or other individuals to Wellness Solutions premises.

  • Wellness Solutions does not provide child care and is not responsible for supervision of minor clients prior to or after a session.

  • In order to maintain privacy and confidentiality, as well as, the integrity and safety of the therapeutic environment, the only individuals permitted in session are appropriate parent(s)/guardian(s)/client representative(s), the client, and Wellness Solutions staff. (The siblings, friends, and other guests are not permitted in the treatment session as it violates the confidentiality and privacy of the client).

  • Wellness Solutions does not provide supervision for children or other minors while a client’s parent(s)/guardian(s)/client representative(s) meets with Wellness Solutions staff regarding the client’s care. Parent(s)/guardian(s) are not permitted to leave minors unattended or unsupervised while on Wellness Solutions premises. Please be advised that improper supervision of a minor is reportable to child protective services (CPS).

  • Wellness Solutions requests that all individuals visiting our premises maintain a tranquil, peaceful, confidential, and respectful treatment environment for clients, client’s family members, and staff.
